1.1 This privacy policy describes how Serneholt Estate and other companies operating under the estate agent Serneholt Estate (“Serneholt”) collect and process your Personal Data.

1.2 Your privacy is important to Bjurfors and we want you to always be able to feel safe when you provide your Personal Data to us. That is why we have this privacy policy to explain what Personal Data we process about you and how we process and protect them. This privacy policy also describes your rights and how you can contact us if you have any questions about how we process your Personal Data.

2. PERSONAL DATA CONTROLLER

2.1 Serneholt conducts estate agency business abroad through a large number of local estate agent offices. In order to always give you as an existing or prospective customer the best possible experience of Serneholt Estate, whichever local estate agent office you go to or if you use our object search at www.serneholtestate.com, the whole of Serneholt will take joint responsibility for processing your Personal Data. All companies that conduct estate agency business under the Serneholt brand share Serneholt’s common customer database and are jointly responsible for ensuring that the Personal Data in the customer database are processed in accordance with the applicable data protection legislation.

3. HOW WE COLLECT AND PROCESS YOUR PERSONAL DATA

3.1 General

Personal Data are any information relating to an identified or identifiable natural person that can directly or indirectly identify a person (“Personal Data”). In this section we describe what kinds of Personal Data we process about you and why, what legal bases we have for processing them and how long we store them. To make our privacy policy as transparent as possible, we have split this section into different categories of persons. 3.2.1 What kinds of Personal Data do we process?

Serneholt collects and processes the following Personal Data when you visit our website: (i) information on how you use our website and (ii) technical data such as your IP address or other unique data that can identify the device you are using as well as the operating system, type of browser and general geographic location data.

3.2.2 Why do we process your Personal Data?

Serneholt processes your Personal Data for the following purposes: (i) to ensure the technical function of our website and (ii) to analyse how you use our website so we can improve and develop it.

Serneholt collects and processes the following Personal Data when you register for a viewing through Serneholt’s website or by contacting Serneholt: (i) name and surname; (ii) email address; (iii) telephone number; (iv) address (if you choose to enter your address); and (v) details of which viewing you have registered for.

If you express an interest in entering the bidding during or after the viewing, Serneholt may request additional information about you in order to administrate the bidding, for example whether you have received a loan commitment from your bank.

3.4.2 Why do we process your Personal Data?

Serneholt processes your Personal Data for the following purposes: (i) to administrate the viewing; (ii) to be able to contact you after the viewing and answer any questions you have asked during the viewing; and (iii) to market Serneholt, our services, events and properties.

3.4.3 Legal bases for our processing of your Personal Data

The processing carried out as above is based on our legitimate interest (where applicable) to: (i) administrate viewings; (ii) contact you to answer any questions you have asked in connection with the viewing; (iii) administrate the subsequent bidding; and (iv) market our business, services, events and similar.

3.4.4 How long do we store your Personal Data?

We store your Personal Data for marketing purposes for two years from the last time you registered for a viewing or actively expressed an interest in Serneholt’s services in some other way. If you choose to unsubscribe from our mailings, Serneholt will stop sending information for marketing purposes and your account will then be handled through our deletion routines, i.e. your Personal Data will be deleted or stored in accordance with the other sections of this policy.

3.5.2 Why do we process your Personal Data?

Serneholt processes your Personal Data for the following purposes: (i) to administrate the viewing/sales start event; (ii) to be able to contact you after the viewing and answer any questions you have asked during the viewing/sales start event; and (iii) to market Serneholt, our services, events and properties.

3.5.3 Legal bases for our processing of your Personal Data

The processing carried out as above is based on our legitimate interest (where applicable) to: (i) administrate viewings/sales start events; (ii) contact you to answer any questions you have asked in connection with a viewing/sales start event; and (iii) market our business, services, events and similar.

3.5.4 How long do we store your Personal Data?

We store your Personal Data for marketing purposes for two years from the end of the new building project for which you last registered your interest. If you choose to unsubscribe from our mailings, Serneholt will stop sending information for marketing purposes and your account will then be handled through our deletion routines, i.e. your Personal Data will be deleted or stored in accordance with the other sections of this policy.

3.6.2 Why do we process your Personal Data?

Serneholt processes your Personal Data for the following purposes: (i) to administrate the reservation and provide information to the contractor; (ii) to comply with legal requirements; and (iii) to document the sales process and defend ourselves against possible legal claims.

3.6.4 How long do we store your Personal Data?

Your Personal Data are stored for ten (10) years after the completion of the reservation/booking/purchase in order for Bjurfors to document the sales process and defend us against possible future legal claims.

3.7 If you place a bid for a property for which Serneholt acts as agent.

3.7.1 What kinds of Personal Data do we process?

Serneholt collects and processes the following Personal Data when you place a bid for any of the properties for which Serneholt acts as agent: (i) name and surname; (ii) contact details; (iii) details of which property you have placed a bid on; (iv) the time of the bid; and (v) details of the bid you have placed, such as the amount and any terms of the bid.

3.7.2 Why do we process your Personal Data?

Serneholt processes your Personal Data for the following purposes: (i) to administrate the bidding and forward the bids that have been placed to the seller and relevant bidders; (ii) to be able to comply with legal requirements; and (iii) to be able to document the sales process and defend ourselves against possible legal claims.

3.8 If you contact Serneholt because you are interested in selling your property or if you have your property valued through Serneholt

3.8.1 What kinds of Personal Data do we process?

If you choose to fill out our contact form on Serneholt’s website, we will record the following Personal Data about you: (i) name; (ii) email address; (iii) region; and (iv) telephone number.

Serneholt will then contact you and, depending on what Personal Data you provide, Serneholt will record the following personal data about you: (v) address and (vi) details of your current residence.

If you choose to appoint Serneholt to conduct a valuation of your property, we will also record details of the valuation we have made of your property.

3.8.2 Why do we process your Personal Data

Serneholt processes your Personal Data for the following purposes: (i) to be able to contact you in accordance with your instructions; (ii) to provide you with the information you have requested; (iii) to be able to book a valuation of your property; and (iv) to market Serneholt, our services, events and properties.

3.8.3 Legal bases for our processing of your Personal Data

The processing is necessary for Serneholt to be able to take such action and provide such information as you have requested before you enter into a possible agreement with Serneholt to act as agent for your property. The processing of your Personal Data for marketing purposes is based on our legitimate interest in marketing our business, services, events and similar.

3.8.4 How long do we store your Personal Data?

We store your Personal Data for marketing purposes for two years from the last time you showed an interest in selling your property or actively expressed an interest in Serneholt’s services in some other way. If you choose to unsubscribe from our mailings, Serneholt will stop sending information for marketing purposes and your account will then be handled through our deletion routines, i.e. your Personal Data will be deleted or stored in accordance with the other sections of this policy.

3.9 If you purchase or sell a property through Serneholt

3.9.1 What kinds of Personal Data do we process?

Serneholt collects and processes the following Personal Data about you when you purchase or sell a property through us: (i) name and surname; (ii) address; (iii) telephone number; (iv) email address; (v) personal identification number; (vi) details of which property you have bought or sold; (vii) the purchase price and any other terms under the transfer agreement; and (viii) the time of the purchase or sale.

3.9.2 Why do we process your Personal Data?

Serneholt processes your Personal Data for the following purposes: (i) to be able to act as agent for the property in question in accordance with the agency agreement; (ii) to comply with legal requirements; and (iii) to defend legal claims.

3.9.3 Legal bases for our processing of your Personal Data

The processing carried out as above is based on the following legal bases: (i) it is necessary to fulfil the agency agreement with the seller; (ii) it is necessary to meet Serneholt’s legal requirements; and (iii) it is necessary for Serneholt’s legitimate interest in being able to defend possible future legal claims.

3.9.4 How long do we store your Personal Data?

Your Personal Data are stored for ten (10) years after we have stopped acting as agent so that Serneholt can document the sales process and defend against possible future legal claims.

3.10 If you attend any of Serneholt’s events

3.10.1 What kinds of Personal Data do we process?

If you choose to register for any of Serneholt’s events, we will record the following Personal Data about you: (i) name; (ii) email address; (iii) telephone number; (iv) information about the event; and (v) details of any special dietary requirements.

If you attend any of Serneholt’s events, we may also take photos of you for the purpose of publishing such photographs on social media.

3.10.2 Why do we process your Personal Data?

Serneholt processes your Personal Data for the following purposes: (i) to send you notifications or messages related to the event you have registered for; (ii) if you have expressed any special dietary requirements – to meet such special dietary requirements at the event; (iii) to publish photos from events on social media and thereby inform about our activities; (iv) to invite you by email to other events that we organise and that we believe may be of interest to you; and (v) to market Serneholt, our services, events and properties.

3.10.3 Legal bases for our processing of your Personal Data

The processing carried out as above is based on our legitimate interest in informing about and marketing Serneholt and our business, services, events and similar.

3.10.4 How long do we store your data?

We store your Personal Data for marketing purposes for one year from the last time you registered for an event or actively expressed an interest in Serneholt’s services in some other way. If you choose to unsubscribe from our mailings, Serneholt will stop sending information for marketing purposes and your account will then be handled through our deletion routines, i.e. your Personal Data will be deleted or stored in accordance with the other sections of this policy.

3.11 If you are a contact of one of Bjurfors’s suppliers or partners

3.11.1 What kinds of Personal Data do we process?

Serneholt collects and processes the following Personal Data about you if you are a contact for one of our suppliers or partners: (i) contact details, e.g. name, email address and telephone number and (ii) employment information, e.g. employer, work title and address of workplace.

3.11.2 Why do we process your Personal Data?

Serneholt processes your Personal Data for the following purposes: (i) to send you notifications or messages relating to an agreement between your company and Serneholt; (ii) to be able to otherwise fulfil, maintain and carry out our obligations under a contract with your company; (iii) to discuss possible future contractual relationships between your company and Serneholt; and (iv) to provide you with information about Serneholt’s products or services, or to invite you to activities or events.

3.11.3 Legal bases for our processing of your Personal Data

The processing carried out as above is based on our legitimate interest (where applicable) to: (i) uphold, maintain and administrate a contractual relationship that we have with your company; (ii) uphold the cooperation/partnership with your company and discuss possible future contractual relationships with your company; and (iii) market, promote and inform about our business, products, solutions, services, events and similar.

3.11.4 How long do we store your Personal Data?

If your company has a contractual relationship with us, we will store your Personal Data until the contractual relationship with your company ends. However, we will continue to process your Personal Data (if these are in the text of the agreement) as part of the text of the agreement, as long as the agreement is stored, for the purpose of safeguarding Serneholt’s legal interests.

3.13 If you send email to Serneholt

3.13.1 What kinds of Personal Data do we process?

Serneholt will process the following Personal Data about you if you contact us via email: (i) name, (ii) email address and (iii) any other Personal Data you provide in the email to us.

3.13.2 Why do we process your Personal Data?

We process your Personal Data for the purpose of replying to your email.

3.13.3 Legal bases for our processing of your Personal Data

The processing carried out as above is based on Serneholt’s legitimate interest in answering your email and continuing communication with you if you so wish.

3.13.4 How long do we store your Personal Data?

Personal Data in the form of emails are automatically deleted after one year as part of Serneholt’s internal routines. If you have provided Personal Data in the email that we have not requested and do not need, we reserve the right to delete the whole email immediately. If our correspondence results in you instead being covered by one of the other categories in this Policy, we will process and store your Personal Data in accordance with what is stated under the relevant category.

4. TO WHOM DO WE DISCLOSE YOUR PERSONAL DATA?

4.1

Serneholt will not sell or lend your Personal Data to third parties. However, Serneholt may share your Personal Data with such partners as we engage to provide our services to you. We may also share your Personal Data with our client (building firm/developer) in our role as agent for new building projects. Such partners/clients may be given access to your Personal Data when they carry out services on our behalf for the purpose of meeting the objectives of the processing of your Personal Data in accordance with Section 3 above, but they may never use your Personal Data for any other purpose.

4.2

Serneholt will not transfer your Personal Data to any country outside the EU/EEA.

4.3

Personal Data may be disclosed by Serneholt if required by law or regulatory requirements or it is necessary for us to protect our legal interests or to detect or prevent fraud or other security problems.

5. HOW WE PROTECT YOUR PERSONAL DATA

5.1

You should always be able to feel safe when you provide your Personal Data to us. Serneholt has therefore taken the necessary security measures to protect your Personal Data against unauthorised access, change and deletion.

5.2

To ensure that Personal Data are processed securely and confidentially, Serneholt uses data networks that have intrusion protection, including firewalls and industry-standard password protection. To ensure the integrity of the Personal Data you provide via the Internet, Serneholt may use encryption technology when transferring such Personal Data over the Internet to our servers. Serneholt’s safety procedures are constantly updated in line with technological developments.

6. YOUR RIGHTS

Access, changes and additions

6.1 You always have the right to know what Personal Data we process about you and to access these. This means that you can request a so-called register extract of the processing we carry out of your Personal Data. You also have the right to receive a copy of the Personal Data that are processed. In addition, you can always ask us to change or update your Personal Data.

Restriction, deletion and data portability

6.2 In special circumstances (as set out in the applicable data protection legislation), you have the right to ask Serneholt to restrict the use of or delete your Personal Data. You also have a right to data portability. This is a right, under certain conditions, to obtain and transfer your Personal Data in a structured, commonly used and machine-readable format to another personal data controller.

Objections

6.3 You have the right to object to Personal Data processing that is carried out after weighing up the interests. If you object to such processing, we will only continue the processing if there are legitimate reasons for the processing that outweigh your interests.
